Class Eligibility

You are a member of the Settlement Class, and therefore part of this Settlement, if you were a current or former ASC employee whose PII was disclosed as a result of the ASC Phishing Attack. If you received a notice, you are a member of the Settlement Class and a part of this Settlement.

AllClear Identity Repair. All Settlement Class Members have been automatically enrolled in AllClear Identity Repair (formerly called AllClear SECURE), which provides identity repair and restoration assistance.

AllClear Credit Monitoring. Additionally, all Settlement Cass Members are able to enroll, free of charge, in AllClear Credit Monitoring (formerly called AllClear PRO), which includes, among other benefits, credit monitoring and a $1 million identity theft insurance policy. Settlement Class Members who do not enroll in AllClear Credit Monitoring/PRO will not be entitled to reimbursement for any Tax Refund Claim or Unauthorized Transfer and Identity Theft Claim.

Tax Refund Claim: If after the ASC Phishing Attack you became a victim of tax refund fraud, you may receive up to $750 cash reimbursement for fees you paid to a certified tax preparer or attorney to notify the Internal Revenue Service of the fraud, or to assist in resolving issues arising from the fraud. To file a Tax Refund Claim complete the claim form. The deadline to file a claim is June 30, 2017.

Unauthorized Transfer and Identity Theft Claim: If you became a victim of identity theft after the ASC Phishing Attack, and you suffered losses because your identity was stolen that were not reimbursed by AllClear identity theft insurance coverage or by your payment card company or financial institution—such as unauthorized transfers or charges on credit or debit cards—you may receive up to $1250 cash compensation for those unreimbursed debit or credit card charges or other charges or fees paid to financial institutions. To file an Unauthorized Transfer and Identity Theft Claim complete the claim form. The deadline to file a claim is June 30, 2017.

Case Summary

On March 7, 2016, ASC was the victim of a phishing attack, resulting in the disclosure of personally identifiable information (“PII”) concerning current and former ASC employees. Specifically, an outside third party obtained unauthorized access to employee PII through a phishing-type attack by posing as an ASC employee. The third party convinced an ASC employee to provide a file containing information about certain individuals who worked for ASC during 2015. Plaintiffs claim that ASC did not adequately protect their personal information and that they were injured as a result of the ASC Phishing Attack. ASC denies any wrongdoing, and no court or other entity has made any judgment or other determination of any wrongdoing or that the law has been violated.
