Bank of America Text Message Class Action Settlement

Class Members of the Bank of America TCPA settlement include all individuals who:

• Mortgage Calls – received non-emergency, default servicing telephone calls from Bank of America regarding a Bank of America Residential Mortgage Loan Account to a cellular telephone through the use of an automatic telephone dialing system and/or an artificial or prerecorded voice between Aug. 30, 2007 and Jan. 31, 2013
• Credit Card Calls – received non-emergency, default servicing telephone calls from Bank of America regarding a Bank of America Credit Card Account to a cellular telephone through the use of an automatic telephone dialing system and/or an artificial or prerecorded voice between May 16, 2007 and Jan. 31, 2013
• Credit Card Texts – received non-emergency, default servicing text messages from Bank of America regarding a Bank of America Credit Card Account to a cellular telephone through the use of an automatic telephone dialing system and/or an artificial or prerecorded voice between Feb. 22, 2009 and Dec. 31, 2010

Note, you can qualify for multiple categories, and consequently can file for multiple claims in these different classes

This settlement resolves several class action lawsuits that allege Bank of America violated the TCPA by using automatic dialers without the express consent of customers. Bank of America denies these allegations but has agreed to settle the case.
