Case Summary

According to the settlement the publisher disclosed its customers’ subscription information to third parties for marketing purposes without obtaining permission which is in violation of Michigan privacy law. According to the plaintiffs the defendant disclosed subscriber info – including full names, addresses, and magazine subscription titles – to third parties for marketing purposes without securing permission. According to the plaintiff this disclosure was in violation of Michigan’s Video Rental Privacy Act and constituted a breach of contract with Bauer’s subscribers.

The publisher denies wrongdoing but has agreed to settle to avoid the cost and uncertainty associated to litigation.
