Case Name
Bruce M. Cooper, et al. v. Charter Communications, Inc., et al., No. 3:12-cv-10530-MGMDistrict Court for the District of Massachusetts
Case Summary
This lawsuit claims that Charter Communications, Inc. and Charter Communications Entertainment I, LLC (hereinafter “CCE”) should have granted credits to customers for outages for twenty-four or more consecutive hours caused by severe weather events that knocked out the customer’s cable TV, telephone or internet services and/or the customer’s electricity thereby precluding access to cable TV, telephone or internet services, and that CCE failed to clearly, conspicuously and accurately disclose its credit and refund policy to its Massachusetts customers. The Plaintiffs allege that CCE is liable for damages for the four relevant time periods – May 31, 2011 through June 30, 2011; August 27, 2011 through September 26, 2011; October 29, 2011 through November 29, 2011 and February 7, 2013 through March 6, 2013.
