Class Eligibility
You may be a Class Member if you are a resident of the United States , its territories, or at any U.S. military facility or exchange, who purchased one of several citronella candles or pest foggers for personal use between May 4, 2015 and June 7, 2021.
The following products offered by United Industries Corp. are covered in the settlement:
Cutter citronella candles,
Repel citronella candles,
Black Flag total release foggers,
Do It Best total release foggers,
Eliminator total release foggers,
Green Thumb total release foggers,
Hot Shot total release foggers,
No Pest total release foggers,
Real-Kill total release foggers,

Case Summary
The Plaintiffs claim that the Defendant (United Industries Corporation) used deceptive marketing in claiming the efficacy of their citronella candles sold under the Cutter and Repel brands (“Covered Candles”), as well as their total release foggers sold under the Black Flag, Do It Best, Eliminator, Green Thumb, Hot Shot, No Pest, Real-Kill, Rid-A-Bug, Spectracide, and TAT brands (“Covered Foggers”). These two sets together comprise the “Covered Products” of the suit. The Defendant denies all such allegations.
