All persons who on or after January 1, 2013 through April 11, 2017, received a Gift Card, through FabFitFun or any of its Vendors, with an expiration date that is earlier than the expiration period provided under applicable federal or state gift card laws. (the “Settlement Class”).

Case Summary
Plaintiff filed this class action lawsuit against FabFitFun, Inc. (“FabFitFun”), Merrithew International Inc., Zumba Fitness, LLC, Physique 57 International Inc. and Reeds Jewelers, Inc. (collectively, the “Vendor Defendants” and together with FabFitFun, “Defendants”) alleging that they violated certain state laws pertaining to Gift Cards by selling and causing to be distributed various Gift Cards with an allegedly unlawful expiration date. Defendants deny Plaintiff’s allegations, raise certain defenses thereto and contend that they agreed to settle the case only to avoid the expense of further protracted litigation. The parties have agreed to the settlement described in this Notice.
