Case Name: | Dennis v. Kellogg, Case No. 3:09 – CV – 01786 – IEG(WMC) |
Case Summary: |
The plaintiffs alleged that Kellogg falsely advertised it’s Mini-Wheats cereal as improving children’s brain power, boosting attentiveness, memory, and other cognitive functions. Kellogg continues to stand by these ridiculous claims, but settled the case before it went to court. This is a case where we think Kellogg should have won by virtue of it’s claim being so daft, nobody could possibly have been misled by it. If anyone purchase mini-wheats because they thought it would make their children smarter, we question the wisdom of giving that person $15 let alone allowing them to retain custody of the child. Nonetheless, thanks to some marketers overzealous claims, Kellogg is being forced to gift it’s customers $15. Think of it as compensation for their insulting your intelligence. |
