Mapco Express Data Breach Settlement
The Class includes all persons in the United States and its Territories whose personal or financial data was stolen from MAPCO’s data systems (in the form of data from debit, credit, or other payment cards), and who were damaged thereby as a result of the data breach disclosed by MAPCO on or about May 6, 2013. Excluded from the class are the Court and the officers and directors of MAPCO.

On August 20, 2014, Plaintiff Mandi Phillips filed a Class Action Complaint (the “Complaint”) in the United States District Court for the Middle District of Tennessee against MAPCO. See Case No. 3:14-cv-01710 (M.D. Tenn.). The Complaint was brought on behalf of a class of all persons in the United States and its Territories who have had personal or financial data stolen from MAPCO’s data systems and who were damaged thereby as a result of the data breach disclosed by MAPCO on or about May 6, 2013. The Complaint alleged the following causes of action against MAPCO: (1) intentional violations of the Fair Credit Reporting Act; (2) negligent violations of the Fair Credit Reporting Act; (3) invasion of privacy by public disclosure of private facts; and (4) negligence. The claims were based on, among other things, the allegation that MAPCO negligently failed to prevent the Data Breach.
