• Plaintiffs, Marshalls and HomeGoods Merchandise Assistant Store Managers (“Merchandise ASMs”), claim that Merchandise ASMs should have been paid overtime for all hours worked over 40 in a week. The lawsuit claims that Merchandise ASMs perform non-exempt tasks as their primary duties, as described in Section I below.
