Case Name: | Flannery, et al. v. McCormick & Schmick’s Seafood Restaurants, Inc., et al., Case No.: BC487942 |
Case Summary: |
The plaintiffs allege that McCormick & Schmick falsely advertised that it sold Kobe beef, which was not actually Kobe beef in the sense that it did not come from Kobe, Japan (and presumably came from Kentucky). We are amused that this settlement covers not just Californians that paid for the non-Kobe Kobe beef, but also those that saw the menu. It seems like that the case alleges that people were harmed just by seeing the menu. It is equally amusing that the remedy for being sold fake Kobe beef is a gift voucher to buy more products from the false Kobe beef selling restaurant. |
