|Case Name:||In Re: Aurora Dairy Corp. Organic Milk Marketing and Sales Practices Litigation|
Aurora Organic Dairy produces organic milk, organic butter, and other organic dairy products for major store brands including Wal-Mart, Target, CostCo, Safeway, and Wild Oats.
Several lawsuits were filed against Aurora Organic Dairy, claiming that the milk was not USDA organic, and that pictures on the milk carton showing happy cows munching on pastures were misleading because the cows were not so happy and were living in an environment more like a factory farms.
The courts sided with Aurora Farms found the milk was in fact certified USDA organic. But, the misleading marketing claims were still being litigated when the parties decided to settle.
The class action law suit has it’s roots in sanctions by the USDA against Aurora in August 2007 and placed the company on probation with Aurora agreeing to change some practices. The sanctions were a result of an investigation by The Cornucopia Institute, an advocacy group for organic farming. You can read more Cornucopia’s coverage of the issue here. We could not find any statements on Aurora’s website providing their opinion on the issue.
It brings joy to our heart to know that so many class action lawyers care so deeply about cows being happy. Although as fellow animal lovers, we would have liked to see the settlement funds go to compensate the unhappy cows. Perhaps extra juicy pastures and cow waterbeds.
