You are a class member if you purchased certain Sinus Buster products between 3/7/2012 and 2/20/2014. Products included in this settlement are:

• Sinus Buster
• Sinus Buster Mild
• Sinus Buster Anti-Cold Formula
• Cold Buster
• Allergy Buster
• Sinus Buster Allergy Formula
• Headache Buster
• Sinus Buster Headache Formula

$5 per product up to two products without proof of purchase

Full refund in all purchases for those providing proof of purchase

Not needed but if presented the amount will be equal to a full refund for each of the products where the proof of purchase is available.

The plaintiffs contend that Hi-Tech, the manufacturers of Sinus Buster a line of capsaicin-based drugs that are marketed and sold online and in retail stores for between $10 and $15 per bottle, made claims indicating that capsaicin has the ability to treat sinus congestion and related cold and allergy symptoms. These over-the-counter homeopathic products have not been evaluated or approved by the FDA. According to the class action lawsuit, Hi-Tech falsely represented that Sinus Buster products were effective for their advertised purpose, homeopathic, FDA-approved, and proven effective.
The class action alleges that Hi-Tech misrepresented the efficacy of their Sinus Buster products in violation of consumer protection and warranty laws. The plaintiffs claim they would have not purchased the products had they been labeled accurately. Hi-Tech denies wrongdoing but has agreed to settle to avoid the expenses and uncertainty of ongoing litigation
