Case Summary:

The plaintiffs claim that Valor Glass Front fireplaces did not disclose that the glass front can get so hot they can cause burns. The defendant thought that this should be obvious and denies that consumers were unaware of this potential danger. (Inside the legal fraternity this is called the ‘duh defense’ The parties settled the case before the court had to settle this complex matter.

We think the provision of this screen is ridiculous. Why someone with a beautiful minimalist glass fronted fireplace would want a screen is beyond me. The whole point of this fireplace is for the fire to not be obscured. The cynic in me say that it is because this is a way the defendant could provide something that cost them very little but could be submitted to the court as having a high value and would in turn allow the plaintiff’s attorneys to justify getting a high fee (up to $1.89 MM in this case).
