Purchasers who saw a Barney’s Beanery menu (instore or online) that advertised Kobe beef in the state of California and purchased such menu items containing the word “kobe” between 10/3/08 and 01/27/2014.

Case Summary:

The plaintiffs allege that Barney’s Beanery falsely advertised that it sold Kobe beef, which was not actually Kobe beef in the sense that it did not come from Kobe, Japan.

According to the plaintiff, Barney’s Beanery engaged in unfair business practices, violations of the Consumers Legal Remedies Act. The class action lawsuit alleged that the restaurant’s actions constitute fraud, intentional misrepresentation and negligent misrepresentation.

Barney’s denies the allegations but has agreed to settle to avoid the cost and uncertainty of extended litigation
