Brazilian Blowout Class Action Settlement

Class Eligibility:

The settlement covers anyone that underwent treatments using Brazilian Blowout Products (consumers) before June 6, 2012. The settlement also covers professionals the delivered the treatment (stylists)

Estimated Amount:

Consumers are entitled to receive $35 per treatment of Brazillian Blowout, up to a maximum of three treatments ($105). No proof of purchase is needed for a claim of one treamtne ($35). Proof of purchase (e.g. receipt, statement from your stylist, cancelled check, etc) is necessary for claims of more than one treatment.

Stylists and salons are entitled to $75 per purchase of Brazilian Blowout. For unused product, you may chose to exchange the product for Brazillian Blowout Zero (presumably without Formaldehyde) instead of taking the $75.

Medical expenses incurred by consumers or stylists related to using the product (e.g. eye disorders, nervous system disorders, respiratory tract disorders, or nausea hypotrichosis) can claim expenses up to $2,000.

Amounts may be reduced if the fund gets exhausted, and amounts may be increased if the fund is undersubscribed.

Case Summary:

The plaintiffs claim that Brazilian Blowout, a hair straightening and smoothing product, which were marketed as being safe, formaldehyde free, and without hard chemicals were in fact containing formaldehyde and were carcinogenic. The defendants deny the claim and the case was settled before a court could adjudicate the matter.

If the allegations are true, this is a truly scary example of false advertising. Formaldehyde free, no actually it contains formaldehyde. Safe, no actually it is carcinogenic.
