Imprelis Tree Damage Settlement

Class Eligibility:

The settlement covers property owners who used Imprelis, or were adjacent to a property where Imprelis was used between 8/31/10 and 8/21/11, and whose trees were damaged as a result of Imprelis by 2/11/13.

Estimated Amount:

The settlement pays for care for damaged trees, removal of damaged trees, replacement of the damaged trees, and maintenance of replacement trees. You may also claim additional damages for loss of enjoyment, and receive a warranty on trees that currently do not show damage, and a warranty on any replacement tree.

Payments for damaged trees that qualify for replacement will depend on the height of the tree, varying from $30 (1 foot) to $19,000 (100 feet)

Proof of Purchase:

If you file a claim, an assessor will come to your property to determine the level of damage.

Case Summary:

The plaintiffs sued DuPont, the makers of Imprelis a herbicide intended to kill weed, alleging that product also harmed some types of evergreen trees. As these side effects became more apparent, Imprelis was withdrawn from the market by DuPont and subsequently prohibited by the EPA.
